Appointment of a solicitor
It is sensible advice to appoint a solicitor to represent you in
the sale of your property because complications can arise. We will
assist in the negotiations. More importantly we will prepare your
capital gains tax returns and negotiate who pays what.
Documentation
The following documents should be lodged with us when putting your
property up for sale.
- Copy of the Escritura (Title Deeds)
- Copy of the latest Impuesto Sobre Bienes Inmuebles (IBI) receipt
(Real Estate Tax).
- Copy of your last Spanish Income Tax Declaration.
- Copies of all utility service bills.

Fees
Estate agencies usually charge between 3 and 10% of the selling price.
5% Retention
The buyer's lawyer will retain 5% of the purchase monies to pay anything due
to the Treasury Of The Tax Office on account of your potential liability
to Capital Gains Tax.
Debts
You are obliged to settle any outstanding mortgage or debts. |
